The website www.edog.fr, the App and the eDOG service (hereinafter “our Services”) are provided by eDOG, a French simplified joint-stock company (SAS) registered with the Bordeaux Trade and Companies Register (RCS) under number 911 038 032, whose registered office is located at 153 Bouthier, 33100 Bordeaux, France (hereinafter “eDOG” or “We”). 

eDOG is committed to protecting the privacy of all visitors, Customers and Users of its Services. It undertakes to collect and process your data in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (“Loi Informatique et Libertés”) (together, the “Data Protection Regulations”).

This Privacy Policy sets out our commitments and the fundamental principles we apply to the protection of personal data. It informs you of how your data is collected and used, and of the options and rights available to you. It supplements the General Terms of Use of the Service. Capitalised terms not defined herein have the meaning given to them in the said General Terms of Use.

We may amend this Privacy Policy at any time, in particular to comply with any regulatory, case-law, editorial or technical developments. Customers and Users will be informed by any appropriate means of any significant change to the Policy. We invite you to refer to its latest version each time you browse our Services.

Who does this policy apply to?

The collection and processing of personal data concerns all visitors, Customers and Users of our Services.

When you sign up or access our Services, you will receive all the mandatory information relating to the collection and processing of your Data.

In accordance with our General Terms of Use, access to our Services is restricted to persons aged 18 or over.

What personal data do we process?

When you create an eDOG account, complete your Registration and use our Services, the following personal data may be collected and processed:

• Identification data (surname, first name, date of birth, selfie, identity document, driving licence, BCR);
• Contact data (email, postal address, phone number);
• Payment data (bank details);
• Scooter location data (pick-up and drop-off locations, ride history);
• Browsing data (IP addresses, log data, browser type and version, type and version of your browser plugins, operating systems and platforms, your device’s advertising identifier);
• Location data from your mobile device.

When do we collect your personal data?

Personal data comes from the information you provide to us directly when you Register for our Services.

Your ride history is collected when you use our Services.

When you visit our Website or App, browsing and location data derived from cookies or similar technologies will be collected.

Data may also be collected when you take part in a competition or a customer survey, or when you contact our customer service team.

What information do we provide when collecting your data?

When your data is collected, you are informed in particular of:

• The purposes for which the data is collected;
• Whether certain data is mandatory or optional and, where applicable, the consequences of failing to provide mandatory data (if mandatory data is not provided, access to the Services will not be possible);
• eDOG’s status as data controller;
• Your rights and how to exercise them with eDOG;
• The legal basis for the processing (for example, whether the processing is based on your consent, on compliance with a legal obligation, on the performance of the contract between us, or on the legitimate interests of eDOG or a third party);
• The categories of persons authorised to access your data (i.e. the recipients of your data);
• Where we intend to transfer your data outside the European Union, the safeguards we put in place to ensure that such transfers comply with the Data Protection Regulations;
• The retention periods or, where this is not possible, the criteria used to determine them;
• And, more generally, all the information required by the Data Protection Regulations.

We keep your personal data for as long as is necessary for the purposes for which it was collected and in compliance with the regulations. We then erase the personal data, unless we still need it (for evidential purposes, for civil-law claims, for a period not exceeding 5 years, or because of legal retention obligations).

For what purposes do we use your personal data, and for how long?

* For all requests, the following data is retained: name, contact details, subject and history of exchanges.

Data may be collected for other purposes in connection with certain specific or temporary services. In that case, information about such processing will be provided in a specific document when the Data is collected.

Who receives your data?

The recipients of the data are:

• eDOG, its subsidiaries and affiliated companies, the departments involved in processing your registration, and our customer service team;
• our service providers and processors, in particular for processing your payments or verifying your documents;
• our insurance company (and/or our insurance broker) in the event of claims and thefts;
• the competent police authorities in the event of an offence;
• municipal authorities, in order to improve transport services;
• more generally, the competent authorities, solely upon request, in order to comply with legal obligations.

Data transfers outside the EU

eDOG may use, in particular, a file storage and sharing service and a rights management provider whose servers or systems may be located outside the European Economic Area (EEA), resulting in the transfer of Data outside the EEA.

These transfers are subject to appropriate safeguards ensuring the confidentiality, integrity and security of the Data in accordance with the Data Protection Regulations. You can obtain a copy of these safeguards by contacting the data controller by email (contact@edog.fr).

Information derived from cookies and similar technologies may be transferred outside the European Union for hosting and processing for advertising or audience measurement purposes.  

Is your data secure?

We undertake to take all appropriate precautions and organisational and technical measures to preserve the security, integrity and confidentiality of the Data and, in particular, to prevent it from being altered, modified or  deleted, or accessed by unauthorised third parties.

In particular, we have taken the following measures:

• We use encryption when transmitting your personal data to ensure its security;
• Access to the network and information systems is restricted to staff with access rights;
• Users have unique passwords (password management ensuring strong passwords and two-factor authentication);
• Firewalls

However, we cannot guarantee that all risk of misuse of the Data is eliminated. It is important that you keep your login credentials confidential to prevent unlawful use of your account.

What are your rights?

In accordance with the Data Protection Regulations, and subject to payment of all sums due as specified in the General Terms of Use of our services, you may at any time withdraw any consent you previously gave us when signing up for our services.

You may access and obtain a copy of your data, have it rectified, object to its processing under certain conditions, or have it erased.

You also have the right to restriction of processing of your Data and the right to data portability to third parties.

Finally, you may set out instructions regarding what happens to your Personal Data after your death.

Lodging a complaint with the CNIL

If, after contacting us, you believe that your rights regarding your data have not been respected, you may lodge a complaint with the CNIL (the French data protection authority).
